Terms and Conditions - Dymos Online Ordering

1. Acceptance of Terms

By accessing or using the Dymos Online Ordering platform, provided by Software Engineering Concepts, Inc., you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the service.

2. Service Overview

Dymos provides a technical interface that allows you to view menus and place orders with independent third-party restaurants ("Merchants"). Please note that:

The Merchant is responsible for the preparation, quality, and accuracy of the food.
The Merchant is responsible for setting prices and availability.
Software Engineering Concepts, Inc. is the platform provider and is not a party to the food preparation.

3. User Accounts

To place an order, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to provide accurate and complete information during the registration process.

4. Ordering and Payment

Pricing: Prices are determined by the Merchant and may include delivery fees, service fees, and applicable taxes.

Payment: You agree to pay all charges incurred by your account. All payments are processed securely. Charges are generally non-refundable once an order has been prepared or dispatched.

Cancellations: Cancellation requests must be made directly to the Merchant. The Merchant’s specific refund and cancellation policies apply.

Orders cannot be cancelled or refunded once food preparation has begun. If an item you ordered is unavailable due to ingredient shortages, we will attempt to contact you via text/SMS at the phone number provided at checkout. If we do not receive a response within five (5) minutes, we reserve the right to either: (a) make a safe and reasonable substitution of equal value, or (b) cancel the unavailable item and issue a refund/void for that portion of the order. By providing your phone number, you consent to receive order-related text messages; standard message and data rates may apply.

5. Intellectual Property

All content on this platform, including software, text, graphics, and logos, is the property of Software Engineering Concepts, Inc. or its licensors and is protected by copyright and intellectual property laws.

6. Limitation of Liability

To the maximum extent permitted by law, Software Engineering Concepts, Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service, including but not limited to food quality issues or delivery delays caused by the Merchant.

7. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page. Your continued use of the platform after changes are posted constitutes acceptance of those changes.
